Booking Terms & Conditions

After you have forwarded an enqiury to us using the website enquiry form, we will check availability and notify you by email usually within 24 hrs. If a late booking ,�we may contact you provisionally by text , or telephone in order to make progress quickly for you.
If you are happy with the arrangments proposed by us , quoted price etc, a completed booking form with signature must be sent to our office , duly signed by a named member of the group ( from this moment on known as the CLIENT)with a deposit of 10% of the TOTAL COST of the booking.
The�CLIENT will then be notified when the booking is PROVISIONALLY confirmed by email, (usually within 24hrs) A FINAL invoice and final confirmation will be sent by email to the client for the balance of the booking cost which must be paid at least 8 weeks prior to departure. If the booking is made less than 8 weeks before departure , full payment must be paid after receiving confrmation of avaiablity of booking. The booking will only be deemed as FULLY CONFIRMED after all the balance has been forwarded to YourPhilippines.co.uk and duly processed through our bank account. Upon clearance by our bankers a FULL CONFIRMATION email will be sent to the CLIENT( postal confirmation can be requested by the�CLIENT if preferred) which includes ALL and FULL details of the booking made.
Deposits for bookings made by credit card more than 8 weeks before departure will not be deemed accepted until a signed booking form has been recieved by us and we have issued a confirmation. If a signed booking form has not been recieved within 7 working days of the booking being made then the booking will be deemed cancelled ,the deposit will be forfieted and the booking made available to other customers. Bookings made by credit card less than 6 weeks pror to departure ( payment of booking is required in FULL) will be governed by our cancellation policy within these terms and conditions whether a booking form has been recieved or not by us.
If the balance due for your booking has not been recieved by us and cleared by our bankers at least 8 weeks before departure , your booking will be cancelled all all deposits forfeited.
The person making the booking (CLIENT) and signing the booking form must be over 18 years of age at the time of booking and will be regarded as being responsible for payments of the total booking cost inclusive of any amendments made to the booking , and any subsequent cancellations. He or She also agrees to provide us with full and accurate information regarding all of the other members of the party ( if applicable)as per the booking form. By signing the booking form , it is confirmed that he/she and ALL other memebers of the party , including any that may be added at a later date, agree to be bound by these conditions. When you make the booking , you will have to either pay the deposit or the full amount due if its booked less than 8 weeks before departure. All special requests regarding travel , accomodation etc other than those which are a standard part of your booking , have to be advised to us at the time of booking.We will pass this information onto the companies or third parties to which your booking relates. No guarantee will be given regarding special requests , and although we will try our best to satisfy our clients needs at all time , the clients must be aware that any special request IS SUBJECT TO AVAILABILITY. and therefore YourPhilippnes.co.uk accepts no responsibility for special requests not being available , unless specifically confirmed on the Final Confirmation /Invoice.
PAYMENT
Payment must be as per stated on the Provisional Confirmation email.
Payments by Credit card will incurr a 4% admin charge
It is the responsibilty of the the CLIENT to check confirmations, invoices and communications between YourPhilippines.co.uk and the CLIENT and inform us immediatley if anything is incorrect. Spelling of names etc is particularly important as names must match any names on Passports , we cannot accept any responsibility if an airline or other supplier refuses boarding etc�because the name(s) on the passport differ from those on ticketsor vouchers. Payments�of any monies due must be paid to us at least 8 weeks prior to departure. If you do not pay the palance by the due date your booking will be cancelled and you will forfeit any deposit paid to us.
TRAVEL DOCUMENTS
Any travel documents will be sent to you at least 2 weeks before departure date. If the client wishes for the documents to sent by registered mail, an admin cost of £10 will be charged and added to the final invoice. This must be stated on the booking form at the time of booking. No liability will be accepted by YourPhilippines.co.uk for any documents lost in transit.
CHANGES TO BOOKING
A fee of £35 will be made for any change made to the original booking. If for some reason you want to change to another holiday/ tour package or instigate a change of departure date and or length of your holiday/tour, we reserve the right to make an admin charge of £50 per booking change per person in party.The CLIENT must notify us in writing at least 55 days in advance of departure. Also any change in booking/tour will result in any charges made to Your Philiippines.co.uk by accomodation or service providers being passed on to the CLIENT.
Any changes made to the booking by the CLIENT within 55 days of departure will be treated as a cancellation of the original booking and will be subject to our normal cancellation policy and charges for cancellations will apply.
Bookings are FULLY transferable subject to following conditions being met :-
YourPhilippines.co.uk is notified in writing , stating reason why the original person cannot travel.
Written evidence must be sent to us as to why the original person cannot travel ie Doctors certificate , and must be accompanied by ALL original travel and booking documents that have been sent to the CLIENT by us, along with FULL details of the person to be included onto the original booking ( Name, Full Postal Address , age etc.
The new party member must forward to us a written undertaking to agree to ALL Terms and Conditions as per the original booking.
An admin charge of £50 per person transferring onto the original booking shall be payable. The CLIENT shall be the one responsible for forwarding this to us before the alteration will be verified and confirmed.
Where airline tickets are concerned , it is quite common for airlines to treat name changes as a cancellation of the origial booking. In this event , a new ticket will have to be purchased with no refund available for the original booking.
CHANGES TO PACKAGES/TOURS /SERVICES OFFERED.
We reserve the right to change any of the facilities, services or prices descrbed in our litrature or on the website. If any changes occur you will be advised at the time of booking , and before a contract is entered into between the CLIENT and Your Philiipines.co.uk.
CHANGES TO YOUR BOOKING MADE BY US
In th unlikley event that WE have to make any changes to your booking after confirmation , ie different hotel , lower standard of accomodtion etc, the client will be notified as soon as posible. As many bookings and their content are arranged many weeks in advance of departure date ,�it is sometimes , but very rarely, necesssary to alter a significant aspect of the booking. If this becomes necessary , the client will be notified as soon as possible. Most changes are of a minor nature, but if significant the CLIENT will have the choice of a complete refund and cancelling the original booking accepting the new changes , or transferring to another of our packages to the same value.
The aforesaid offers from YourPhilippines.co.uk will not be valid if changes have to be made as a result of 'force majeure.
The details of compensation that will be offered if all the above criteria are met are as follows :-
note* It is srongly recommended that no transport arrangments are made , airline tickets bought etc , until Full Confirmation from Your Philippines.co.uk is recieved by the CLIENT. In the event of expenses being incurred before Full Confirmation has been recieved by the CLIENT , then no liablity will be accepted by Your Philippines.co.uk in respect of any compensation for monies paid by the Client or party.
Compensation
Period within which a major change is notified to you:-
Before Date Balance is Due - £0 - 00p
Between balance due date and 14days before departure - £40 - 00p
Between 13days and the date of Departure - £50 - 00p
Compensation will not be payable if we are forced to cancel or in any way change your booking for reasons out of our control including but not exclusiviley limited to force majeure , namley war , threat of war , riot , civil strife , industrial dispute , terrorist activity , health epedemics , natural or neuclear disasater , fire or adverse weather conditions or other similar events beyond our control and that of our suppliers.
If WE CANCEL YOUR HOLIDAY
Very rarely it may be necessary to cancel your booking and we always reserve the right to cancel your booking in any circumstances. However , in no circumstances will we cancel your booking less than 8 weeks before your scheduled departure date except for reasons of force majeure or failure on your part to pay the final balance. In circumstances where we are unable to provide the holiday/tour booked we will return to you all monies paid or where possible offer an alternative holiday/tour of comparible or higher standard with compensation if appropriate. In case of a cancelled departure we strongly advise you not to book any connecting travel that is non refundable or non changeable or incurs penalties. We will not be liable to refund any costs inurred for visas , vaccinations or other travel arrangements. If we are forced to cancel your holiday/tour after departure date we will , wherever possible, make suitable arrangemenets . If we are unable to make such alternative arrangements or you reject these for good reason , then we will return you to your point of departure and refund you for any unused portions of your booking/ service if appropriate.
COMPENSATION or LIABILITY
Our obligations and that of our suppliers providing services or facilties included in your holiday/tour are to take resonable skill and care to arrange for the provision of such services and facilities and , where we or our suppliers are actually providing the service or facility, to provide them and to do so with reasonable care and skill. You must show that reasonable care and skill has not�been��used if you wish to make any claim . Standards of , for example, safety , hygiene , and quality vary with the transport and destinations that your holiday/tour may involve. Sometimes these standards may be lower than those which you would expect in the UK.The services and facilities included in your holday/tour will be deemed to be provided with reasonable skill and care if they comply with any LOCAL regulation which apply, or if there are no applicable local regulations , that they are resonable when compared to local standards and customs.
For claims which do not involve death or personal injury , we accept , and will only have liablity should we or our suppliers fail to satisfy the obligations detailed above. If we have liablility, we will pay you reasonable compensation ( limited to twice the value of your holiday) if your enjoyment of the tour is adversley affected. Any sums recieved by you from the suppliers such as from accomodation providers, tour organisers , sports organisations etc thee�will be deducted from the value of compensation provided by Your Philippines.co.uk to the CLIENT
For claims which involve death or personal injury as a result of an activity forming part of your holiday /tour, we accept , and will only have liability should we fail to satisfy our obligations detailed above. If we have liability , we will pay you reasonable compansation.
We shall have no liability where the cause of the failure to provide or failure in, , your holiday/tour or any death or personal injury you may suffer is not de to any fault on our part, because it is either attributable to you , or attributable to someone unconnected with your holiday and is unforseeable or unavoidable , or it is due to unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care and attention had been exercised , or an event which we we couldnt have foreseen or fairly avoided.
If any international convention applies to or governs any of the services or facilities included in your holiday/tour arranged or provided by us , and you make a claim against us arising out of death or injury, loss or damage sufferred during or as a result of the provision of those services or facitilies , our liability to pay you compensation and /or the amount ( if any) of compensation payable to you by us will be limited in accordance with and / or an identical manner to that provided for in the international convention concened ( in each case including in respect of the conditions of liability , the time for bringing any claim and the type and amount of any damages that be be awarded)
International Conventions that may apply include :- in respect of rail travel ... The Bearne Convention1961 . In respect of carriage by sea .... The Athens Convention 1974 . In respect of carriage by road ....The Geneva Convention 1973., and in respect Hotels .... The Paris Convention 1962 . Copies are avilable upon request.. For the avoidance of doubt , this means that we are to be regarded as having all the benefits of any limitations of compensation contained in any of these conventions or any other conventons that might be applicable to your holiday/tour.
If you choose to issue court proceedings in respect of a claim against us , you must do so within 2 years of your return from the holiday in question , or withinn 2 years of first discovering the matters giving rise to the claim, if this is later. If you do not , then our liabilty to you will be limited in all cases to the sum of £100.
Other than set out above , and as detailed alsewhere in these booking terms and conditions , we shall have no liability whatsoever to you for any loss , damage . personal injury or death which you suffer arising directly or indirectly from any aspect of your holiday/tour.
INDEPENDENT ARRANGEMNTS/ EXCURSIONS.
Any arrangements you make independently which do not form part of the holiday/tour booked by us are entirely at your own risk. Where you book any excursions or additional travel arrangments while on your holiday/tour we act only as your booking agents..
TRAVEL INSURANCE
Travel Insurance is mandatory for all clients booking with YourPhilippines.co.uk. If you have chosen not to take the insurance scheme we offer then you are responsible for ensuring that you are in possession of current travel insurance for the complete duration of your holiday/tour for at least any medical expenses, repatriation, cacellation and curtailment, with cover/ benefits equal to or greater than the insurance we offer. If you make your own insurance arrangements , you must ensure that there are no exclusion clauses which limit cover for the type of activities included in your tour/holiday. Travel documents will not be issued unless you provide evidence of the existance of your policy to Your Philippines.co.uk
PASSPORTS & VISAS
It is the responsibility of the Client and any member of the party to check the requirements for visa and passports for the country that you are visiting. Making sure that your visa and passport are still valid for the full term of your holiday/tour. No liability will be accepted by YourPhilippines.co.uk in respect of any loss to the client as a result of not having the right valid documents.
People with convictions may not be allowed into the country so its the individual travellers responsbility to check with the National Embassies concerned before travelling. that they will will be allowed into the country if they have any convictions.
HEALTH
It is the clients responsability to ensure that you obtain proper and detailed advice. Where you do not do so and either you are not allowed into the country , or suffer personal injury or death then Your Philippines.co.uk� are not liable to you for any cost , loss or damage which you may suffer nor will we refund you the cost of any unused portion of your travel /holiday arrangements. Clients with existing medical problems, pregnant women , and anyone who has recently visited other countries should check rquirements wth their doctor before booking or travelling.
YOUR CONTRACT WITH YOUR US
On signing the booking form the CLIENT does so�on behalf of ALL members of the party in respect of the booking . Therefore signing of the booking form states that ALL party members accept all the terms and conditions of yourphilippines.co.uk. Also they agree to the authority of any employees, agents ,group leaders ,and suppliers of services while on the tour/holiday. If in the opinion of any of the afore mentioned agents etc your behaviour or health appears likely to endanger the progress of the tour/holiday , you may be excluded from the whole , or part of the tour/holiday. In respect of ill health we may make any arrangments as we deem necessary and recover the costs from you. If you commit an illigal act we shall cease to have any responsibility for or to you.
ITINERARIES.
Because of the nature of some of the activitites that we might be arranging for you , it is your resposbility to make sure that you are able to complete the said tour and that you are flexible in your attitude to allow for activities in a different country. Itineraries on our website and any written material should be taken as a statement of our intent , rather than a contractual obligation on our part. . Unforeseen local conditions or events may sometimes mean we have to make changes to the itinerary , accomodaion , or means of transport. We accept your booking on the understanding that you realize that the potential hazards involved in this kind of trip , including injury, desease or loss and damage to personal property , inconvenience and discomfort. Refunds will not be given for any unused part of the holiday/tour.
CANCELLATON
If you cancel your booking more than 8 weeks before departure we will not refund your deposit , but you may if you wish transfer your deposit to another tour/holiday in our current programme ( provided you are not already booked on it) on payment of a transfer admin fee of £50, suject to your notifying us in writing within 7 days of your cancellation, telling us which holiday/tour you wish to transfer to and paying the full tranfer admin fee. If the holiday you transfer to is more expensive than the one you have cancelled a further deposit will also be rquired . If you subsquently cancel the holiday/tour onto which you have transfered, we will retain all deposits paid. Transfer is subject to another holiday/tour being available.
The Client may , by notice in writing to Your Philippines.co.uk, cancel their booking at any time. In the event of the cancellation after the booking has been confirmed, the folowing cancellation charges will apply
56 days or more prior to departure -loss of deposit
42- 55 days " -�50% of total cost
32-41 days "- 75% of total cost
0 - 31 days "- 100% of total cost
Cancellations must be in writing signed by the CLIENT who first signed the booking form.
We will notify you as soon as possible if through no fault of our own� we have to significantly alter or cancel your holiday/tour. In these circumstances you can choose one of the following options :-
a) Cancel your holiday and recieve a full refund.
b) Accept a substitute holiday if one is available.If of lesser value we shall also refund the difference in the two bookings.
We will not however be liable to you for any arrangements made by you in respect of travelling etc if you made them before you recieved Final Confirmation of your itinerary and we have previously advised you against it as per other sections of these term and comditions.
RULES ABOUT ACCOMODATION BOOKED
Any accomodation booked with YourPhilippines.co.uk is only for the use of the named customer on the booking form. subletting, sharing, or assigment is forbidden.
All damages and breakages will be charged to the Client and must be paid for before checking out. The Client and party agree to behave in an orderley manner and not to disrupt the enjoyment of other Clients and members of other parties booked or other guests at the accomodation , or in any way harm the reputation of our company.The holiday/tour of any Client or member of the booked party found to have broken any of these rules will have their holiday/tour cancelled with no recompense due from YourPhilippines.co.uk. All contractual obligations will also cease to be in force.
Any claims for damges ,�injury that are covered by your insurance must be directed to your insurance company in the first instance
It is agreed that on signing the booking form and therefore agreeing to the terms and conditions herewith. the customers agrees that YourPhilippines.co.uk is only acting as the agent for suppliers of tours, accomodation , etc on behalf of the client.therefore our liability is limited in regards to any claim where it is clearly established that the claim is with the supplier, accomodation provider, transport company etc. However we will endevour to settle any dispute as quickly as possible and to complete� to the satisfcation of the customer as a gesture of goodwill and with no admittance of guilt or responsability.
COMPLAINTS
If you have any complaints about the holiday/tour or any other service we have provided to you you�must first make it known to the local represetative of the company that has provided the service in the locationas soon as possible.
If you are still not satisfied and feel your enjoyment will be affected, your should contact our office immediatley so we can try to give you satisfaction in this matter.
If on your return you are stll not satisfied with our efforts to sort out your problem . You should put your complaiunt in writing within 30 days of your scheduled return to the UK at which point we will try to settle thecomplaint to everyones complete satisfaction.
LIABILITY
* Your Philippines .co.uk agrees to take all reasonable steps to provide the booked holiday/tour as described on the website , but will not be responsible if , having used all reasonable efforts it is unable to do so.
* We accept no liability ( except where it is proved that we did not use due dilligence) for any loss or damage incurred or suffered by any client in connection with any mode of transport in any way arising from the holiday/tour.
* Any baggage and personal belongings remain at all times and in all circumstances at the owners own risk except where it has been proved that we failed to use due dilligence.
* Whilst Your Philippines.co.uk always uses due diligence in all its efforts to ensure that all descrpitions and /or information on its website and any written material in relation tothe the holidays tours provided are accurate , it shall not be held liable in the event that any aspect of the holiday/tour fails to comply with any description or information even if the Client specifically relied on that information for choosing and booking that holiday/tour provided YourPhilippines has used at all time due diligence in all matters.
DISCLAIMER
Information on our website is posted in good faith and is updated regularly. However we cannot be held resposible for any incomplete or inccurate or misleading information contained on it.Prices shown on the website are believed to be correct and accurate , but in the event of any inacurracy, typing error etc the price quoted on the Provisional confirmation will superseed any price given on the website and will be the valid price for invoice and payment purposes.
Although all resonable steps are taken to assure accuracy on the website, much of the information is prepared and added to the website many weeks and months in advance and because of this some information may be out of date. Therefore some offers, and / or facilities and arrangments may have to be withdrawn due to adverse weather conditions, lack of demand , maintainance etc. and therefore you should be prepared for this eventuality.. Air conditioning and other electrical services where mentioned and or expected may�unavailable at certain times due to power failure which are quite common in the Philiipines, although many hotels etc have their own power generators for this eventuality. If any signifcant change to any facility that we think might adversly effect your holiday/tour we will endevour to notify you as soon as this comes to our attention and before departure if at all possible.
We resrve the right to change information , prices etc to anything contained on our website at anytime after publication.
MEDICAL CONDITIONS
If any member of the party have any medical condition or disability which may effect your holiday/tour, please inform us so that we can advie as to the suitablilty of the booking. In any event you must inform us in writing at the time of booking and reserve the right to refuse any booking that we feel we or our suppliers cannot meet the needs of the Client. We also resreve the right to cancel the booking if full details of a medical condition that might effect the holiday only became apparent to us after booking�was completed.
DATA PROTECTION
In order to process your booking we will need to collect certain personal details from all members of the party booking with us.This may include personal information needed to arrange special requests such as disabilities, medical conditions etc as well as any dietry conditions that might effect religious beliefs.
If any such details are needed we will inform you as soon as possible before we obtain them from you. We will also need in certain circumstance to forward this information to other parties involved in the arrangments for your holiday.
We would also like to store your information on our datsa base for future marketing by YourpPhilippines only. We will not forward your information to any other party without your permission.
If you dont want any of your information keeping on file please let us know that this is your wish. Appropriate measures have been taken to protect all information stored about you by YourPhilippines.co.uk
